Terms and Conditions and Statement of Rights and Responsibilities

DoostNama is a social networking platform that allows members to create unique personal profiles online in order to find and communicate with oldand new friends. This Statement of Rights and Responsibilities ("Statement") derives from the DoostNama Principles listed below, and governs our relationship with users and others who interact with Doostnama. This Terms of Use Agreement, as may be modified from time to time, ("Agreement") constitutes legally binding terms and applies to your use of the DoostNama.We are building Doostnama to make the world more open and transparent, which we believe will create greater understanding and connection. Doostnama promotes openness and transparency by giving individuals greater power to share and connect, and certain principles guide Doostnama in pursuing these goals. Achieving these principles should be constrained only by limitations of law, technology, and evolving social norms. We therefore establish these Principles as the foundation of the rights and responsibilities of those within the Doostnama Service.

Freedom to Share and Connect: People should have the freedom to share whatever information they want, in any medium and any format, and have the right to connect online with anyone - any person, organization or service - as long as they both consent to the connection.

Ownership and Control of Information: People should own their information. They should have the freedom to share it with anyone they want and take it with them anywhere they want, including removing it from the Doostnama Service. People should have the freedom to decide with whom they will share their information, and to set privacy controls to protect those choices. Those controls, however, are not capable of limiting how those who have received information may use it, particularly outside the Doostnama Service.

Free Flow of Information: People should have the freedom to access all of the information made available to them by others. People should also have practical tools that make it easy, quick, and efficient to share and access this information.

Fundamental Equality: Every Person - whether individual, advertiser, developer, organization, or other entity - should have representation and access to distribution and information within the Doostnama Service, regardless of the Person's primary activity. There should be a single set of principles, rights, and responsibilities that should apply to all People using the Doostnama Service.

Social Value: People should have the freedom to build trust and reputation through their identity and connections, and should not have their presence on the Doostnama Service removed for reasons other than those described in Doostnama's Statement of Rights and Responsibilities.

Open Platforms and Standards: People should have programmatic interfaces for sharing and accessing the information available to them. The specifications for these interfaces should be published and made available and accessible to everyone.

Fundamental Service: People should be able to use Doostnama for free to establish a presence, connect with others, and share information with them. Every Person should be able to use the Doostnama Service regardless of his or her level of participation or contribution.

Common Welfare: The rights and responsibilities of Doostnama and the People that use it should be described in a Statement of Rights and Responsibilities, which should not be inconsistent with these Principles.

Transparent Process: Doostnama should publicly make available information about its purpose, plans, policies, and operations. Doostnama should have a town hall process of notice and comment and a system of voting to encourage input and discourse on amendments to these Principles or to the Rights and Responsibilities.

By using or accessing Doostnama, you agree to this Statement.

Privacy

Your privacy is very important to us. We designed our Privacy Policy to make important disclosures about how you can use Doostnama to share with others and how we collect and can use your content and information. We encourage you to read the Privacy Policy, and to use it to help make informed decisions.

This Privacy Policy describes Doostnama’s use and sharing of personally identifiable information (“PII”-- your full name, email address, mailing address, telephone number, or credit card number) that Members voluntarily provide to Doostnama when they register (also known as “Registration PII”). The Term “User” refers to a Visitor or a Member. This Privacy Policy applies to the services offered by Doostnama, including any Doostnama-branded URL (the “Doostnama Website”), the Doostnama instant messaging service, and other features (for example, music and video embedded players), Doostnama mobile services, and any other features, content, or applications offered from time to time by Doostnama in connection with the Doostnama Website (collectively, the “Doostnama Services”). The Doostnama Website is a general audience site and does not knowingly collect PII from children under 13 years of age.

From time to time Doostnama may modify this Privacy Policy to reflect industry initiatives or changes in the law, our PII collection and use practices, the features of the Doostnama Services, or technology, and such modifications shall be effective upon posting by Doostnama on the Doostnama Website. Your continued use of the Doostnama Services after Doostnama posts a revised Privacy Policy signifies your acceptance of the revised Privacy Policy. It is therefore important that you review this Privacy Policy regularly to ensure you are updated as to any changes. If Doostnama materially changes its practices regarding collection or use of your PII, your PII will continue to be governed by the Policy under which it was collected unless you have been provided notice of, and have not objected to, the change.

COLLECTION AND SUBMISSION OF PII AND NON-PII ON DOOSTNAMA

General. When Doostnama collects PII from you it is because you are voluntarily submitting Registration PII to us in order to register as a Member of Doostnama. Doostnama may also collect PII from you if you choose to participate in Doostnama Services activities like sweepstakes, contests, and surveys, because you want us to furnish you with products, services, newsletters, or information, or in connection with content or suggestions you submit to Doostnama for review.

In addition, Doostnama collects other non-PII including IP address, aggregate user data, and browser type. This data is used to manage and improve the Doostnama Services, track usage, and for security purposes.

Doostnama Members may also choose to provide or store non-PII information in their profiles, including but not limited to date of birth, interests, hobbies, lifestyle choices, groups with whom they are affiliated (schools, companies), videos and/or pictures, private messages, bulletins or personal statements (collectively “Profile Information”). The Profile Information in a Member’s profile is provided at his or her sole discretion.

Doostnama Members can change their Registration PII and Profile Information at any time and can control how Visitors, other Members and Doostnama communicate with them by controlling their account settings, available within the “Edit Profile” portion of their Doostnama profile.

Cookies. Cookies are small bits of information that Doostnama places on your computer. Doostnama uses cookies to identify your Internet browser, store Users’ preferences, and determine whether you have installed the enabling software needed to access certain material on the Doostnama Services. Data in cookies may be read to authenticate user sessions or provide services.

Third party advertisements displayed on Doostnama Services may also contain cookies set by Internet advertising companies or advertisers (known as “third party cookies”). Doostnama does not control these third party cookies and Users of the Doostnama Services should check the privacy policy of the Internet advertising company or advertiser to see whether and how it uses cookies. See the “Notice” section below for more information on customized advertising on Doostnama. A pixel tag is a tiny image inserted in a webpage and used to record the number and types of views for that page. Doostnama may allow third party pixel tags to be present on Doostnama Services for purposes of advertising, providing services or data and statistics collection.

You can program your computer to warn you each time a cookie is being sent, block third party cookies or block all cookies. However, by blocking all cookies you may not have access to certain features on the Doostnama Services.

NOTICE: DOOSTNAMA WILL PROVIDE YOU WITH NOTICE ABOUT ITS PII COLLECTION PRACTICES

When you voluntarily provide PII to Doostnama, we will make sure you are informed about who is collecting the information, how and why the information is being collected and the types of uses Doostnama will make of the information to the extent it is being used in a manner that differs from what is allowed pursuant to this Privacy Policy.

At the time you provide your PII, Doostnama will notify you of your options regarding our use of your PII (See “Choice” below). Except as described in this Privacy Policy, Doostnama will not share your PII with third parties unless you have given Doostnama permission to do so (See “Use” below).

Doostnama Services may be linked to Internet sites operated by other companies. Doostnama Services may also carry advertisements from other companies. Doostnama is not responsible for the privacy practices of websites or other services operated by third parties that are linked to or integrated with the Doostnama Services or for the privacy practices of third party Internet advertising companies. Once you leave Doostnama Services via such a link, access a third party application (such as widgets) or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they will handle any PII they collect from you.

Doostnama may use cookies and similar tools to customize the content and advertising you receive based on the Profile Information you have provided. Profile Information you provide in structured profile fields or questions (multiple choice questions like “Marital Status,” “Education” and “Children”) (“Structured Profile Information”), information you add to open-ended profile fields and questions (essay questions like “About Me,” “Interests” and “Movies”) (“Non-Structured Profile Information”) and other non-PII about you may also be used to customize the online ads you encounter to those we believe are aligned with your interests. For example, based on your music interests we might display an advertisement to make sure you are advised when your favorite band is coming to town. The information used for this feature does not provide your PII or identify you as an individual to third parties.

Some of the advertisements that appear on Doostnama Services may also be delivered to you by third party Internet advertising companies. These companies utilize certain technologies to deliver advertisements and marketing messages and to collect non-PII about your visit to or use of Doostnama Services, including information about the ads they display, via a cookie placed on your computer that reads your IP address.

Third party applications (such as widgets) created by third party developers may also be available on the Doostnama Services. Third party applications are small bits of software, often with interactivity, that can be installed into Members’ profiles or shared with other Users. However, Doostnama does not control the third party developers, and cannot dictate their actions. When a Member engages with a third party application, that Member is interacting with the third party developer, not with Doostnama. Doostnama encourages Members not to provide PII to the third party’s application unless the Member knows the party with whom it is interacting.

CHOICE: DOOSTNAMA WILL PROVIDE YOU WITH CHOICES ABOUT THE USE OF YOUR PII

Except as described in this Privacy Policy, Doostnama will get your permission before we use the PII you provide to us in a way that is inconsistent with the purpose for which it was submitted or share your PII with third parties that are not affiliated with Doostnama.

USE: DOOSTNAMA'S USE OF PII

Doostnama will only use the PII you provide under this Privacy Policy in a manner that is consistent with this Privacy Policy. If Doostnama obtains PII from a third party, such as a business partner, our use of that information is also governed by this Privacy Policy.

In order to locate other Doostnama Members that you may already know in the physical world, Doostnama allows Users to search for Members using Registration PII (i.e., full name or email address). Doostnama also allows Users to browse for certain Profile Information in order to help connect with Members (i.e., schools and/or companies where Users may have attended or worked). Doostnama may also enable Members to publicly display some Registration PII as an element of their Profile Information if they choose to do so via a profile setting under “Edit Profile.” Search engines may index the portion of a Member’s profile (including the Profile Information it contains) that is publicly displayed.

If you have consented to receive promotional materials (e.g., newsletters) or notifications from Doostnama, Doostnama may periodically use your email address to send you such materials related to the Doostnama Services, as applicable. If you want to stop receiving such materials from Doostnama, you can change your profile settings under “Account Settings,” or follow the unsubscribe instructions at the bottom of each email.

Doostnama employees, agents and contractors must have a business reason to obtain access to your PII. Doostnama may share your PII with those who help us manage or provide Doostnama Services’ information activities (for example, message board administration, order fulfillment, statistical analyses, data processing), or with outside contractors, agents or sponsors who help us with the administration, judging and prize fulfillment aspects of contests, promotions and sweepstakes.

These outside contractors, agents or sponsors may temporarily store some information on their servers, but they may only use your PII to provide Doostnama with a specific service and not for any other purpose. Doostnama may also provide your PII to a third party in those instances where you have chosen to receive certain information and have been notified that the fulfillment of such a request requires the sharing of your PII. Doostnama also may share your PII with Affiliated Companies if it has a business reason to do so.

As described in “Notice” above, Doostnama may customize the advertising and marketing messages you receive on the Doostnama Website, or may work with outside companies to do so. Your non-PII and/or Profile Information may be shared with these companies so this customization can be accomplished. Doostnama prohibits these companies from sharing your non-PII and/or Profile Information with any third party or from using it for any other purpose. Anonymous click stream, number of page views calculated by pixel tags, and aggregated demographic information may also be shared with Doostnama’s advertisers and business partners.

There may be instances when Doostnama may access or disclose PII, Profile Information or non-PII without providing you a choice in order to: (i) protect or defend the legal rights or property of Doostnama, our Affiliated Companies or their employees, agents and contractors (including enforcement of our agreements); (ii) protect the safety and security of Users of the Doostnama Services or members of the public including acting in urgent circumstances; (iii) protect against fraud or for risk management purposes; or (iv) comply with the law or legal process. In addition, if Doostnama sells all or part of its business or makes a sale or transfer of all or a material part of its assets or is otherwise involved in a merger or transfer of all or a material part of its business, Doostnama may transfer your PII to the party or parties involved in the transaction as part of that transaction.

When a Member who is located in the European Union chooses to post Profile Information that will be publicly disclosed, that Member is responsible for ensuring that such information conforms to all local data protection laws. Doostnama is not responsible under the EU local data protection laws for Member-posted information.

Sharing Your Content and Information

You own all of the content and information you post on Doostnama, and you can control how it is shared through your account settings. In addition:

For content that is covered by intellectual property rights, like photos and videos ("IP content"), you specifically give us the following permission, subject to your privacy and app settings): you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with Doostnama ("IP License"). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
When you add an application and use Platform, your content and information is shared with the application. We require applications to respect your privacy settings, but your agreement with that application will control how the application can use the content and information you share.
When you publish content or information using the "everyone" setting, it means that everyone, including people off of Doostnama, will have access to that information and we may not have control over what they do with it.
We always appreciate your feedback or other suggestions about Doostnama, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).

Safety

We do our best to keep Doostnama safe, but we cannot guarantee it. We need your help to do that, which includes the following commitments:

You will not send or otherwise post unauthorized commercial communications (such as spam) on Doostnama.
You will not collect users' content or information, or otherwise access Doostnama, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on Doostnama.
You will not upload viruses or other malicious code.
You will not solicit login information or access an account belonging to someone else.
You will not bully, intimidate, or harass any user.
You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.
You will not develop or operate a third party application containing, or advertise or otherwise market alcohol-related or other mature content without appropriate age-based restrictions.
You will not offer any contest, giveaway, or sweepstakes ("promotion") on Doostnama without our prior written consent. If we consent, you take full responsibility for the promotion, and will follow our Promotion Guidelines and all applicable laws.
You will not use Doostnama to do anything unlawful, misleading, malicious, or discriminatory.
You will not do anything that could disable, overburden, or impair the proper working of Doostnama, such as a denial of service attack.
You will not facilitate or encourage any violations of this Statement.

Registration and Account Security

Doostnama users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

You will not provide any false personal information on Doostnama, or create an account for anyone other than yourself without permission.
You will not use your personal profile for your own commercial gain (such as selling your status update to an advertiser).
You will not use Doostnama if you are under 13.
You will not use Doostnama if you are a convicted sex offender.
You will keep your contact information accurate and up-to-date.
You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.
You will not transfer your account to anyone without first getting our written permission.
If you select a username for your account we reserve the right to remove or reclaim it if we believe appropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).

Protecting Other People's Rights

We respect other people's rights, and expect you to do the same.

You will not post content or take any action on Doostnama that infringes or violates someone else's rights or otherwise violates the law.
We can remove any content or information you post on Doostnama if we believe that it violates this Statement.
We will provide you with tools to help you protect your intellectual property rights.
If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.
You will not use our copyrights or trademarks (including Doostnama, the Doostnama and F Logos, FB, Face, Poke, Wall and 32665), or any confusingly similar marks, without our written permission.
If you collect information from users, you will: obtain their consent, make it clear you (and not Doostnama) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
You will not post anyone's identification documents or sensitive financial information on Doostnama.

Mobile
1. We currently provide our mobile services for free, but please be aware that your carrier's normal rates and fees, such as text messaging fees, will still apply.
2. In the event you change or deactivate your mobile telephone number, you will update your account information on Doostnama within 48 hours to ensure that your messages are not sent to the person who acquires your old number.
Payments

If you make a payment on Doostnama or use Doostnama Credits, you agree to our Payment Terms.

Special Provisions Applicable to Share Links

If you include our Share Link button on your website, the following additional terms apply to you:

We give you permission to use Doostnama's Share Link button so that users can post links or content from your website on Doostnama.
You give us permission to use such links and content on Doostnama.
You will not place a Share Link button on any page containing content that would violate this Statement if posted on Doostnama.

Special Provisions Applicable to Developers/Operators of Applications and Websites

If you are a developer or operator of a Platform application or website, the following additional terms apply to you:

You are responsible for your application and its content and all uses you make of Platform. This includes ensuring your application or use of Platform meets our Policies and our Guidelines.
Your access to and use of data you receive from Doostnama, will be limited as follows:
1. You will only request data you need to operate your application.
2. You will have a privacy policy or otherwise make it clear to users what user data you are going to use and how you will use, display, or share that data..
3. You will make it clear to users what user data you are going to use and how you will use, display, or share that data.
4. You will not use, display, or share a user's data in a manner inconsistent with the user's privacy settings.
5. You will delete all data you received from us relating to any user who deauthorizes, disconnects, or otherwise disassociates from your application unless otherwise permitted in our Policies.
6. You will delete all data you received from Doostnama if we disable your application or ask you to do so.
7. We can require you to update any data you have received from us.
8. We can limit your access to data.
9. You will not transfer the data you receive from us (or enable that data to be transferred) without our prior consent.
You will not give us information that you independently collect from a user or a user's content without that user's consent.
You will make it easy for users to remove or disconnect from your application.
You will make it easy for users to contact you. We can also share your email address with users.
You will provide customer support for your application.
You will not show third party ads or web search boxes on Doostnama user profiles or Pages.
We give you all rights necessary to use the code, APIs (along with all data received), or tools we provide to you, but only in connection with your application.
You will not sell, transfer, or sublicense our code, APIs, or tools to anyone.
You will not misrepresent your relationship with Doostnama to others.
You may use the logos we make available to developers or issue a press release or other public statement so long as you follow our policies.
We can issue a press release describing our relationship with you.
You will comply with all applicable laws. In particular you will (if applicable):
1. have a policy for removing infringing content and terminating repeat infringers that complies with the Digital Millennium Copyright Act.
2. comply with the Video Privacy Protection Act ("VPPA"), and will obtain explicit, opt-in consent from users prior to sharing with Doostnama user data subject to the VPPA. You acknowledge Doostnama has no obligations under the VPPA.
We do not guarantee that Platform will always be free.
You give us all rights necessary to enable your application to work with Doostnama, including the right to incorporate content you provide to us into streams, profiles, and user action stories.
You give us the right to link to or frame your application and place content, including ads, around your application.
We can analyze your application, content, and data for any purpose, including commercial (such as for targeting the delivery of advertisements and indexing content for search).
To ensure your application is safe for users, we can audit it.
We can create applications that offer similar features and services to, or otherwise compete with, your application.

About Advertisements on Doostnama

Our goal is to deliver ads that are not only valuable to advertisers, but also valuable to you. In order to do that, you agree to the following:

You can use your privacy settings to limit how your name and profile picture may be associated with commercial or sponsored content served by us. You give us permission to use your name and profile picture in connection with that content, subject to the limits you place.
We do not give your content or information to advertisers without your consent.
You understand that we may not always identify paid services and communications as such.

Special Provisions Applicable to Advertisers

You can target your specific audience by buying ads on Doostnama or our publisher network. The following additional terms apply to you if you place an order through our online advertising portal ("Order"):

When you place an Order, you will tell us the type of advertising you want to buy, the amount you want to spend, and your bid. If we accept your Order, we will deliver your ads as inventory becomes available.
You will pay for your Orders in accordance with our Payment Terms. The amount you owe will be calculated based on our tracking mechanisms.
Your ads will comply with our guidelines.
We will determine the size, placement, and positioning of your ads.
We do not guarantee the activity that your ads will receive, such as the number of clicks you will get.
We cannot control how people interact with your ads, and are not responsible for click fraud or other improper actions that affect the cost of running ads.
You can cancel your Order at any time through our online portal, but it may take us seven days before the ad stops running.
Our license to run your ad will end when we have completed your Order. You understand, however, that if users have interacted with your ads, your ads may remain until the users delete it.
We can use your ads and related content and information for marketing or promotional purposes.
You will not issue any press release or make public statements about your relationship with Doostnama without written permission.
We may reject or remove any ad for any reason.

If you are placing ads on someone else's behalf, we need to make sure you have permission to place those ads, including the following:

You warrant that you have the legal authority to bind the advertiser to this Statement.
You agree that if the advertiser you represent violates this Statement, we may hold you responsible for that violation.

Special Provisions Applicable to Pages
1. Pages are special profiles that may only be used to promote a business or other commercial, political, or charitable organization or endeavor (including non-profit organizations, political campaigns, bands, and celebrities).
2. You may only administer a Doostnama Page if you are an authorized representative of the subject of the Page.
3. Pages can only post content and information under the "everyone" setting.
4. When you publish content or information to your Page we have no obligation to distribute your content or information to users.
5. If you use a Fan Box widget off of our site to promote your Page, others will be able to copy and place the widget elsewhere.
6. You may not place a Fan Box widget in an advertisement.
7. If you collect user information on your Page, Section 9 of this Statement also applies to you.
8. If you display advertising on your Page, Section 11 of this Statement also applies to you.

Termination

If you violate the letter or spirit of this Statement, or otherwise create possible legal exposure for us, we can stop providing all or part of Doostnama to you. We will notify you by email or at the next time you attempt to access your account. You may also delete your account or disable your application at any time. In all such cases, this Statement shall terminate, but the following provisions will still apply: 2.2, 2.4, 3-5, 8.2, 9.1-9.3, 9.9, 9.10, 9.13, 9.15.1, 9.18, 10.3, 11.2, 11.5, 11.6, 11.9, 11.9, 11.12, 11.13, and 14-18.

Disputes
1. You will resolve any claim, cause of action or dispute ("claim") you have with us arising out of or relating to this Statement or Doostnama exclusively in a state or federal court located in Santa Clara County. The laws of the State of California will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Santa Clara County, California for the purpose of litigating all such claims.
2. If anyone brings a claim against us related to your actions, content or information on Doostnama, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
3. WE TRY TO KEEP DOOSTNAMA UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING DOOSTNAMA "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT DOOSTNAMA WILL BE SAFE OR SECURE. DOOSTNAMA IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR." WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR DOOSTNAMA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT OR DOOSTNAMA WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, DOOSTNAMA'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
Special Provisions Applicable to Users Outside the United States

We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to users outside the United States:

You consent to having your personal data transferred to and processed in the United States.
If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on Doostnama (such as advertising or payments) or operate a Platform application or website.

Definitions
1. By "Doostnama" we mean the features and services we make available, including through (a) our website at www.doostnama.com and any other Doostnama branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); (b) our Platform; and (c) other media, software (such as a toolbar), devices, or networks now existing or later developed.
2. By "us," "we" and "our" we mean Doostnama, Inc., or if you are outside of the United States, Doostnama Ireland Limited.
3. By "Platform" we mean a set of APIs and services that enable applications, developers, operators or services, including Connect and RSS feeds, to retrieve data from Doostnama or provide data to us.
4. By "information" we mean facts and other information about you, including actions you take.
5. By "content" we mean anything you post on Doostnama that would not be included in the definition of "information."
6. By "data" we mean content and information that third parties can retrieve from Doostnama or provide to Doostnama through Platform.
7. By "post" we mean post on Doostnama or otherwise make available to us (such as by using an application).
8. By "use" we mean use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.
9. By "active registered user" we mean a user who has logged into Doostnama at least once in the previous 30 days.
10. By "application" we mean any application or website (including Connect sites) that uses or accesses Platform, as well as anything else that receives data.

1. This Statement makes up the entire agreement between the parties regarding Doostnama, and supersedes any prior agreements.
2. If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.
